1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you ("Client" or "User") and SoftApps LLC ("Company," "we," "us," or "our"), concerning your access to and use of the https://softappsio.ca website and our digital development services.

2. Intellectual Property Rights

Unless otherwise indicated, all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and trademarks contained therein are owned or controlled by SoftApps LLC and are protected by copyright and trademark laws.

Upon full payment of agreed contract fees for custom development projects, all custom source code rights and deliverables specified in the statement of work shall be transferred to the Client.

3. Software Development Services & Deliverables

SoftApps LLC provides custom iOS, Android, React Native, Mobile, and Web Development services. Scope, timelines, milestones, and payment terms for each development project will be outlined in individual project proposals and client agreements.

4. User Obligations & Conduct

You agree not to access or use the Site for any purpose other than that for which we make the Site available. Prohibited activities include:

• Systematically retrieving data to create or compile a database without written permission.
• Attempting to bypass website security measures or disrupt servers.
• Submitting false or misleading information through lead and contact forms.

5. Limitation of Liability

In no event will SoftApps LLC, its directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the Site or our services.

6. Modifications & Amendments

We reserve the right to change, modify, or remove the contents of these Terms and Conditions at any time or for any reason at our sole discretion without notice. Please review these Terms periodically to stay informed of updates.

7. Governing Law

These Terms shall be governed by and defined following the laws of the State of Texas, USA. SoftApps LLC and yourself irrevocably consent that the courts of Texas, USA shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
